Daimler Buses UK Ltd successfully defends product liability claim

Daimler Buses UK Ltd (“Daimler”), a member of Daimler Truck Group, has successfully defended a product liability claim brought in respect of its market leading Mercedes-Benz Tourismo Coach.  Last Bus Ltd, trading as Dublin Coach, discontinued its claim just before trial in June, paying the majority of Daimler’s costs of the action.

Dublin Coach claimed against Daimler in respect of 30 Mercedes-Benz Tourismo Coaches (the “Coaches”) sold between 2014 and 2017.  Four of the Coaches suffered thermal incidents and Dublin Coach claimed in respect of the thermal incidents and alleged increased costs of repair and time off the road.

Daimler robustly defended the matter throughout, contending that the thermal incidents, repair costs and time off road resulted from Dublin Coach’s operation and inadequate maintenance of the coaches.

The claim was ready for trial at the point Dublin Coach discontinued, with all the automotive engineering, chemistry, metallurgy, and forensic fire expert evidence complete.
