Daniel Shapiro KC to speak at the British Insurance Law Association Virtual Lecture
On 13th September 2023, Daniel Shapiro KC, who acted for the successful W&I Insurers, will use the decision in Finsbury Foods v Axis [2023] EWHC 1559 to illustrate the purpose of W&I insurance, what it is to indemnify, and when an insured is not entitled to indemnity.
Finsbury Foods was the first W&I trial to fight in the Commercial Court where the full spectrum of issues were in dispute: the proper construction of warranties, breach of warranty, SPA exclusions, causation from any breach, valuation of the target company, policy cover and policy exclusions.
