Katie Ayres has successfully resisted an appeal in the Court of Appeal on behalf of her client the Ishinryu Karate Association. The Judgment of the Master of the Rolls provides some welcome clarification on the law as to whether applications to set aside default judgment under CPR 13.3 are applications for relief from sanction to which the Denton test applies. The judgment will have a significant impact on the reach of CPR 3.9 and the Denton test across the CPR.
