Hastings v Finsbury – Supreme Court
Alex Antelme KC and David Myhill appeared in the Supreme Court, on 28th April 2022, in the latest case involving metal-on-metal hip implants. This was a Scottish case in which the Appellant alleged that a Mitch/Accolade hip prothesis was defective within the meaning of the Consumer Protection Act 1987; the manufacturers had won at first instance and on appeal.
Alex and David appeared for Respondents, Finsbury Orthopaedics Ltd and Stryker UK Ltd, together with Kenny McBreaty KC and Ewen Campbell of Axiom Advocates, Edinburgh (instructed by Samantha Silver of Kennedys).
Judgment is awaited.
