Mark Balysz has secured the acquittal at trial of a leading plastics manufacturer
Mark Balysz, instructed by Bob Davies at BLM, has secured the acquittal at trial of a leading plastics manufacturer. The company was prosecuted for breaching s.2 HSWA and regulation 12 PUWER. Pursuant to pre-trial submissions the prosecution opted to pursue the PUWER charge only, considering it an offence of near strict liability. An employee had been seriously injured when molten polymer was sprayed into his face. The issue in the trial was whether such ejection of molten polymer from the company’s machine during operation was a material risk. The jury found the company not guilty in less than an hour of deliberation.
