R (HSE) v Priory Healthcare Ltd

John Cooper KC and Sandesh Singh successfully argue that that the death of Amy El-Keria was not caused by Priory Healthcare Ltd’s breach of section 3 of the Health and Safety at Work etc. Act 1974.

Mr Justice Dingemans sentenced on the basis that culpability was ‘high’ but that there was a low likelihood of death or very serious harm.

The fine imposed was £300,000.

John and Sandesh were instructed by Fiona Gill and Toby Roche at DAC Beachcroft.
