Malcolm Galloway, instructed by Steven Harrison at DAC Beachcroft, has secured the acquittal of a large brickwork company, Winchmore Ltd, after an allegation of breaching s.3 of the Health & Safety at Work Act 1974. On day two of the trial the prosecuting authority, the Health and Safety Executive, offered no further evidence and a not guilty verdict was ordered by the trial judge. The prosecution followed allegations that Winchmore were responsible for the disturbance and damage of a number of boiler flues at a residential building resulting in residents being exposed to the risk of carbon monoxide poisoning, including one resident requiring hospital treatment.
