Property Damage

Rebecca’s property damage experience includes:

  • Acting as Junior Counsel for the successful Defendant in a substantial claim arising out of fire damage to a large warehouse. The case required the consideration technical evidence disputing the cause of the fire and considering the possible smoulder and combustion times for certain types of material.
  • Cases concerning tree-root induced subsidence. She recently acted for the Defendant Housing Association in such a case where the liability of the Defendants was limited to just £5,000 against a claim of approximately £200,000.
  • Drafting of some of the Claimants’ quantum claims arising out of the Buncefield explosion.
  • Flood damage caused by faulty design and / or maintenance mechanical and electrical systems.
  • Flood damage caused by an overflowing culvert in heavy rain.
  • Property damage as a result of construction and demolition works on adjoining land, including the excavation of basements causing damage to the Property next door.

Rebecca recently wrote an article for the Practical Law Company on the decision regarding property owner’s liability for tree-root induced subsidence in Berent v Family Mosaic Housing & London Borough of Islington [2012] EWCA Civ 961, in which she appeared.
