Henk maintains a broad commercial practice, with a particular focus on Construction & Engineering, Insurance, Professional Liability and Property Damage. He has experience of group litigation and international claims which involve jurisdictional or conflict of law issues.
Henk is currently ranked as a “Leading Junior” in Construction and as a “Rising Star” in Professional Negligence. In previous editions, Henk has been described as “very knowledgeable and helpful”; showing “great attention to detail”; “very good on cross-examination”; and “very clever” with a “knack of being able to simplify difficult and complex concepts”. Examples of his recent work include:
- Acting as sole counsel for an architectural services provider in its successful defence of a multi-party negligence claim (c. £900k) arising from design and construction works relating to a residential care home: Firdous v ED & Ors [2025] EWHC 90 (TCC).
- Acting as sole counsel for the owner and developer of several residential blocks in multi-party TCC proceedings (c. £10m+) relating to building safety defects.
- Acting as sole counsel in a contractual dispute in the KBD (c. $850k) relating to the Titanic submersible expeditions operated by OceanGate Inc and associated entities.
- Acting for leaseholders, management companies and other persons in proceedings relating to structural or fire safety defects, including under s.124 of the BSA 2022.
- Acting (with Andrew Rigney KC and Patrick Maxwell) in claims concerning structural and other building defects in residential and mixed-use developments.
- Acting in adjudications relating to (inter alia) extensions of time, delay, variations, loss and expense claims, defective work and entitlements to liquidated damages.
- Acting in a jurisdiction dispute concerning the test for “domicile” under Reg. (EC) No. 1215/2012: Stait v Cosmos Insurance Ltd[2022] EWCA Civ 1429.
- Acting in claims arising from the Freshwater Road Fire in Dagenham.
- Advising on coverage and related disputes arising in the context of professional indemnity, contractors all risks, property damage and building warranty policies.
Henk maintains an academic interest in the law: he is the editor of Chapter 11 (Liability for Design) of Emden’s Construction Law and is working on a book related to the BSA 2022.
