Stewart v Thames Water [2025] EWHC 3130 (KB): High Court upholds decision to grant reverse summary judgment

Nicola Atkins, acting for Thames Water, has successfully resisted an appeal against the grant of reverse summary judgment.
In dismissing the claimant’s appeal on both grounds, Mrs Justice Eady considered that the judge below had been entitled to grant summary judgment on a claim that was almost entirely uncorroborated by evidence. Further, the judge below had not conducted a mini-trial by critically analysing documentary, witness and expert evidence (including a lengthy expert report relied on by the defendant) that undermined the claimant’s case.
