Carlo Taczalski and Liana Turner obtain anti-suit injunction to enforce compliance with exclusive jurisdiction agreement within an English insurance policy

In the latest case involving proceedings pursued in Russia using Article 248 of the Russian Arbitrazh Procedural Code, Carlo Taczalski and Liana Turner have successfully obtained an urgent anti-suit injunction restraining the prosecution of claims worth an alleged £4m+ in the Arbitrazh Court of the City of Moscow. The claims were both for an indemnity under a property insurance policy (in respect of English property), where the policy contained an English choice of law clause, and an exclusive jurisdiction clause in favour of the Courts of England & Wales. The claims were two of an apparently very large number commenced in Russia, by the same individual against a range of English and other foreign defendants.
Carlo Taczalski appeared alone at the final Part 8 trial, before HHJ Pelling KC in September 2025; he led Liana Turner at the stage of obtaining an urgent ex parte interim injunction from Dias J in July 2025.
