Dramatic acquittal in manslaughter trial



Malcolm Galloway and Lucy Wright, instructed by Richard Ottley of DAC Beachcroft and with Dr Richard Brown providing expert support, secured the acquittal of a farmer accused of gross negligence manslaughter.

In a trial at Winchester Crown Court before Mrs Justice Eady, the Jury were directed to return a verdict of not guilty to gross negligence manslaughter on the Judge’s direction. The acquittal was directed before the close of the Prosecution case and was as a result of the concessions made by the Prosecution’s safety expert when cross examined by the Defence.

Following his earlier plea of guilty at the PTPH to two health and safety offences, Mrs Justice Eady imposed a Suspended Sentence Order of 6 months suspended for 18 months and ordered only £2000 in prosecution costs.
