Independent housing provider acquitted of all charges in fire safety case
John Cooper K.C. and Mike Atkins, instructed by Chris Green of Keoghs, have secured the acquittal of a housing association which is a leading independent provider of supported housing. The prosecution, brought by Lancashire Fire and Rescue Authority, followed a fire in which a resident died (https://www.bbc.co.uk/news/uk-england-lancashire-52971886).
The case against the provider was discontinued at Preston Crown Court on 3rd September 2024 after service of an abuse of process application and legal argument setting out preliminary issues regarding the scope of duties under the Regulatory Reform (Fire Safety) Order 2005.
