Carlo Taczalski and Michael Harper successful in forcing discontinuance after 5 week trial
Carlo Taczalski, leading Michael Harper, recently represented Apollo Chemicals Limited (“Apollo”) in a 5 week trial of a claim brought by Sanglier Limited (“Sanglier”). Following the trial, and while judgment is still awaited, Sanglier has discontinued the proceedings against Apollo and agreed to pay a substantial portion of Apollo’s costs of the proceedings.
Sanglier is defending claims brought by a group of companies (“DIPT”) in respect of the supply of (allegedly) defective construction adhesive, which was widely used in England and continental Europe in 2013-14. Sanglier sought to pass onto Apollo any liability which it had to DIPT, together with claiming additional sums from Apollo. Sanglier continues to defend the claims brought by DIPT, but following 5 weeks of lay and expert evidence and submissions, Sanglier has taken the unusual step of discontinuing its claim seeking to pass on that liability to Carlo’s and Michael’s clients, in a vindication of Apollo’s position throughout these long-running proceedings.
