Alutrade Ltd & Ors: Manslaughter Trial Resolves with Fines for Defendants



Alutrade Limited and each of the three individual defendants were represented by Crown Office Chambers Criminal Regulatory Team (see below) in this widely publicised Corporate and Gross Negligence Manslaughter prosecution.  Pleas were accepted by the Crown to Corporate Manslaughter and non-causative s.37 HSWA counts for the individuals, as alternatives to the GNMs charged.  The Prosecution’s submission of Very High Culpability for the HSWA counts was rejected and the respective individual Defendants’ submissions of Medium and Low Culpability were applied.  Fines were imposed on all Defendants (£2m for the Company, with four years to pay; £15,000, £5,000 and £2,600 respectively for the individuals).
