New PD 57AC to apply to trial witness statements in BPD signed on or after 6 April 2021
Isabel Hitching KC was honoured to be appointed by Coulson LJ (former chair of the Civil Procedure Rule Committee) to assist Baker J with drafting the new PD 57AC. This PD, applying to trial witness statements in the Business and Property Courts signed on or after 6 April 2021, addresses the prevalence of overly lengthy statements that ‘walk the court through the documents in the case’ rather than setting out the witnesses’ recollection of factual matters in dispute.
