Healthcare equipment manufacturer absolved of any blame
Assistant Coroner Rachel Galloway today handed down her findings of fact and Conclusion in the Inquest touching upon the death of JXW.
The Court found that the product in question had been used inappropriately and went on to make several critical findings both of the care home in question and attending occupational therapists. A regulation 28 referral has been made to NHS England (due to national-level concerns), the county council, and to the supplier and fitter of the equipment.
Harry’s client, a world leading healthcare equipment manufacturer, was not mentioned in the Regulation 28 referral and indeed was absolved of any and all blame. The court expressly held that had the product been used correctly, the death would have been avoided.
Harry Lambert was instructed by leading commercial firm Simmons & Simmons.
