FCA Test Case
The Commercial Court has handed down judgment in the FCA’s landmark test case concerning the extent to which policies of business interruption insurance respond to the COVID-19 pandemic and in which Andrew Rigney KC and Caroline McColgan acted for the Eighth Defendant, Zurich Insurance PLC. It was found that it was highly unlikely that, on their proper construction, the Zurich wordings which were the subject of the Test Case would provide cover for COVID-19.
