Matthew Boyle obtains finding of fundamental dishonesty after PI claim discontinued

The Claimant claimed damages as a result of an alleged slipping accident at work. Investigation of her Facebook account indicated that she was in fact injured a week later in a tripping accident away from work. The Claimant discontinued the claim just before trial but the Defendant applied for a finding of fundamental dishonesty. Following a hearing in Croydon County Court District Judge Rowland made that finding, ordered the Claimant to pay costs on the indemnity basis and dis-applied the Claimant’s QOCS protection. She now faces a costs liability in excess of £40,000.
