Simon Antrobus KC and Mark Balysz have successfully defended a company and its sole director in relation to corporate manslaughter and s.37 HSWA charges, respectively, in relation to the death of a waste transfer station worker back in 2017. A jury at the Old Bailey found both defendants not guilty of those charges following a 3-week trial before Mrs Justice Thornton. The issues in the case related to workplace transport safety, the degree to which pedestrians could and should be segregated from mobile plant and the true extent of the director’s role and responsibility. Simon and Mark were both instructed by Richard Crockford and Marta Tomlinson of Kennedy’s LLP; with Simon acting for Ace Waste Haulage Limited and Mark for its sole director.
