James Ageros KC and Mark Balysz have secured the acquittals of a leading pool operator and a lifeguard after a trial at Snaresbrook Crown Court.  The pool operator was charged with exposing swimmers to risk in breach of s.3 of the Health and Safety at Work Etc. Act 1974, with its employee being charged with failing to take reasonable care for the safety of swimmers, in breach of s.7.  The prosecution followed the death of a swimmer who remained unnoticed on the bottom of a pool for 6 minutes.  James Ageros KC acting for the operator was instructed by Crispin Kenyon of Weightmans LLP and Mark Balysz, for the lifeguard, was instructed by Colin Moore and Mark Cohen of DAC Beachcroft.
