X Children v Minister for Health & Social Services



David Platt KC commences the largest personal injury claim in British legal history as child abuse victims in Jersey sue the Minister for Health & Social Services for £238 million. He is retained as leading advisory counsel to BCR Law in Jersey to assist Advocate David Benest in X Children v the Minister for Health. The trial is scheduled to last some 8 weeks. As well as complex medical and care evidence, the claims involve a consideration of the law on discount rates and multipliers in assessing future loss. The Defendants seek to argue that the principles in Wells v Wells and Simon v Helmot should no longer be followed given developments in England and Wales and will therefore break important new ground. Detailed actuarial, economic, investment and accountancy evidence will all be called.
