Success for Alexander Macpherson in High Court mesothelioma case
Judgment has been handed down in Hawkes v Warmex Ltd in which Deputy High Court Judge Peter Marquand held that on the available evidence the deceased had not been exposed to asbestos while making electric blankets at a factory in the late 1940s. The decision is interesting because of its consideration of duties under the Asbestos Industry Regulations, the Factories Act and at common law.
