Nadia Whittaker secures a victory for the Claimant in a noise-induced hearing loss case of Lovatt v the Department of Energy and Climate Change before Recorder Male KC sitting at Stoke-on-Trent County Court. The Court rejects the Defendant’s argument that it should escape liability in respect of days where the Claimant was exposed to noise exceeding 90 dB(A) on the basis that noise levels were lower on other days of the week. The Court also rejects the argument of the Defendant’s expert, Mr Parker, that the occupational Békésy audiometry should be preferred to audiometric evidence obtained by the Claimant’s expert, Mr Iqbal, in BSA-compliant conditions. The Claimant is awarded damages in the sum of £1,334 net of apportionment.
