David Platt KC represents Chelsea & Westminster Trust at Sentencing Hearing
David Platt KC represented Chelsea & Westminster Hospital Foundation Trust at its recent sentencing hearing following the death of its employee, Damian Bowen. Mr. Bowen was asphyxiated as a consequence of exposure to liquid nitrogen at research facilities in the St Stephen’s Centre on the Fulham Road. A fine of £80,000 was imposed on the Trust at the sentencing hearing on 12 December 2017 at Southwark Crown Court (HHJ Grieve). The Court accepted the substantially adverse consequences which could arise for the provision of health services in the event of a very substantial fine being imposed. Its co-defendant, Imperial College, was fined £70,000. Both defendants had pleaded guilty to offences under the Health and Safety at Work Act at the first opportunity.
