David Sears KC appeared for Imperial College NHS Trust on its successful application to lift the automatic suspension imposed upon the Trust to enter a new Managed Services Contract for pathology services to Abbott Laboratories Limited. In Sysmex Limited v Imperial College NHS Trust [2017] EWHC 1824 (TCC) Coulson J refused to modify an automatic suspension using the powers given to the court by Regulation 96 of the Public Contacts Regulations 2015 so as to allow the Authority to award everything except that part of the contact for which the claimant bid as a sub-contractor, describing such an order as ‘novel’ and saying it would be ‘impractical and possibly unlawful’.
