Adam Taylor acts pro bono on commercial appeal
Adam was instructed via the Bar Pro Bono Unit to represent the Claimant/Appellant in the case of Guri v (1) Krasniqi (2) Neziraj.
The trial at first instance involved a written contract (in Albanian) for the return of money paid by the Claimant for purchase of a car wash business. However, the trial judge struck out the Claimant’s case as he was unable to rely upon any witness evidence due to non-compliance with court directions. The Claimant appealed on the basis that 1) the trial judge had failed to consider written admissions made by the Second Defendant in his Defence and his two witness statements, and 2) relief from sanctions should have been granted given that the Defendants had also failed to comply with the directions. The appeal was heard by HHJ Dight at Central London county court.
