Nicholas Davies acted for the Claimant in £2.3m damages for a single amputee
The Claimant suffered an above knee amputation of his left leg after he was struck by the propeller of a rescue boat coming to assist him in the water when he fell from a sailing craft. Liability was admitted. The award, agreed shortly before the claim was due on for trial at the High Court, included lifetime provision for an Otto Bock Genium powered prosthetic limb, plus a spare in case of emergencies. The defendants had originally claimed that the award should be limited under the London Convention on Limitation of Liability for Maritime Claims 1976 but that plea was not pursued.
