Simon Antrobus represents firework operator cleared of causing M5 motorway crash in which 7 people died



Simon Antrobus represented the firework display operator, Geoffrey Counsell, who was cleared of a health and safety charge in which it was alleged that smoke from his display at Taunton rugby club caused one of the worst motorway collisions in this country, in which 7 people died. Mr Justice Simon directed the jury to acquit, after ruling there was no case to answer following legal submissions advanced by the defence team at the close of the prosecution case. The judge concluded that there was insufficient evidence to establish exposure to a material risk to safety, as the case was dependent upon hindsight and consequence, rather than foresight and risk.
