Jones v Kaney
The partial immunity of expert witnesses against suits in negligence has been abolished by the Supreme Court in the judgments given in Jones v Kaney UKSC 13. Daniel Shapiro and Roger ter Haar QC acted for the successful Appellant, Mr Jones, against the Respondent, Dr Kaney, an expert psychologist who (it is alleged) was negligent in the agreement of an expert’s joint statement. Following Jones v Kaney the decision of the Court of Appeal in Stanton v Callaghan and the present law on experts’ immunity no longer stand.
