Trevor Frost v David Oldfield (QBD, Manchester District Registry)

Richard Lynagh QC and Jason Evans-Tovey successfully represented the Claimant Mr Frost in his claim for damages in respect of serious injuries sustained when his Kawasaki motorcycle was involved in a high speed collision with an oncoming Moto Morini motorcycle ridden by the Defendant on the A537 “Cat and Fiddle” road in Cheshire.

The central issue in the case was which of the motorcycles had been on the wrong side of the road at the time of the collision.

The case was unusual in that whilst there was eye witness evidence as to events leading up to and immediately following the collision there was no such evidence as to the collision itself. Accordingly the very detailed and conflicting accident reconstruction evidence assumed particular significance.

The Claimant’s expert was Mr John Manderson and the Defendant’s expert was Dr Bryan Chinn.

The trial of liability was heard by Mr Justice McCombe sitting in Liverpool who found in favour of Mr Frost and dismissed the cross claim brought by Mr Oldfield.
