Court of Appeal considers which party should be considered successful following the determination of issues of contributory negligence in a personal injury claim

Sonmez v Kebabery Wholesale Ltd [2009] EWCA Civ 1386 (Ward LJ, Wilson LJ, Sir Paul Kennedy)

Simon J Brown appeared for the Appellant on his appeal after the judge had found him guilty of contributory negligence and awarded his employers their costs. The Court of Appeal decided that the Claimant was the successful party and reversed the order made by the trial judge.
