$130m project insurance dispute

Michael Curtis QC, Charles Pimlott, Crispin Winser, Justin Davis and Siobhan Lambertsen (instructed by Beachcroft LLP) have been acting for a developer in a 10 week international arbitration of a $130m project insurance dispute. The developer was in the course of constructing a luxury resort in the Caribbean comprising a 5 star hotel, condominiums and golf course when Hurricane Ivan struck in September 2004 causing extensive damage. The claim involved complex issues of assessment of damage, quantification of loss, analysis of delay and policy construction together with a vast amount of documentation, 51 factual witnesses and 18 experts. The case concluded at the end of January.
