Simon Howarth appeared for the successful Defendants in this accountant's negligence case, instructed by CMS Cameron McKenna LLP.  The Claimant sought damages of over £577,000 in respect of allegedly defective advice concerning complicated off shore taxation arrangements put in place to safeguard his interests on the sale of his company.  After a 7 day trial, all bar one of the Claimant's claims were dismissed, his factual and expert evidence being largely rejected.

The Claimant recovered only £12,000, and failed to beat a Part 36 offer.  The Court applied Painting v University of Oxford [2005] PIQR Q5, holding that the Defendants were the winners of the litigation, and ordered the Claimant to pay 80% of the Defendants' costs before the offer and 100% of the costs thereafter.
