Current Practice - Summary

David successfully completed his pupillage in Chambers and has been a tenant since October 2007.  He has a broad practice, and is willing to accept instructions in any area of Chambers' work. 

David is happy to consider instructions on a Conditional Fee basis, where appropriate.

 

Practice

Commercial

David is experienced in general commercial litigation, especially claims relating to the provision and supply of goods and services.  He regularly appears at Court and advises in relation to credit hire contracts and debt claims, as well as matters relating to the performance of consumer contracts ranging from the supply and installation of patios and kitchen units to car servicing.

He has particular experience in matters relating to estate agents' commission, and was recently successful in representing a leading estate agent in the recovery of unpaid vendors' commission following a complex three day trial.  He is also experienced in acting for both local authorities and suppliers in relation to claims for contribution brought by local authorities against suppliers as a result of personal injury claims, especially in relation to highway maintenance and social housing maintenance contracts.

 

Construction and Insurance

David also has experience both as a junior to other members of Chambers and in his own right in relation to construction claims.  He was recently instructed as junior counsel in a £3.5m claim in the Technology and Construction Court (Manchester District Registry), and is presently instructed as a junior in relation to the Buncefield litigation.  In addition to such work, David advises on and appears at trial in his own right in smaller disputes, especially those relating to domestic construction and maintenance works.

 

Personal Injury

David has particular experience in Personal Injury claims, in which he regularly represents both Claimants and Defendants at trial in fast and multi track claims across England and Wales.  He has acted in a variety of claims and routinely appears in trials of Employers' liability, Public liability and Occupiers' liability cases, as well as matters arising out of road traffic accidents.  Recent cases on which he has advised or appeared at trial include a child injured on a defective piece of play equipment, an employee at a care home injured whilst moving a patient as a result of deficient manual handling training as well as a range of actions (both for and against local authorities) arising out of highways disrepair.

David also has experience of conducting appeals in the Social Entitlement Chamber against Compensation Recovery Unit certificates issued under the Social Security (Recovery of Benefits) Act 1997.

 

Health and Safety

David also has experience of appearing in the Crown and Magistrates' courts in Health and Safety and road traffic matters, and has frequently represented clients at Coroners' inquests.

 

Professional negligence

David has a growing practice in relation to professional negligence, and has recently advised on claims relating to alleged negligence by solicitors, estate agents and surveyors. 

 

 

Publications/Seminars

David has given talks on the changes introduced by the Sixth Edition of the Ogden Tables in relation to claims for future loss of earnings both as part of Chambers' seminar programme and to the Association of Personal Injury Lawyers.
