His principal fields of work are construction and engineering disputes, professional negligence, insurance and commercial litigation.

 

Construction

Charles has experience in a wide range of construction disputes, including claims for extensions of time, delay and defects claims and claims concerning alleged negligence of surveyors, architects, engineers and other construction professionals.  He has experience of arbitration and adjudication, including advising, drafting submissions and appearing in the High Court on applications for the enforcement of adjudication decisions.  His cases have involved technical issues in civil, structural, mechanical and electrical engineering under a wide variety of standard form and bespoke contracts, often with large amounts of paperwork and involving difficult expert evidence of a highly scientific nature, and contested oral evidence.  His work has ranged from domestic conversions to road building projects, process plant design, transport and telecommunications.  He has significant experience of property damage claims (including cable damage, tree root subsidence, fire and water damage claims), landlord and tenant dilapidations claims and Party Wall Act disputes.

Recent cases have included:

  • A c£500 million international arbitration arising out of a major construction project in Dubai, UAE (2010-).
  • Representing the Defendants in relation to a number of the TCC claims arising out of the Buncefield Litigation (Commercial Court 2008) (2009-).
  • An International Arbitration (seated in Cayman), involving a $120 million project insurance dispute arising out of property damage caused to a 5-star hotel following Hurricane Ivan (2008 - 2010).

 

Professional Negligence

Charles has experience of drafting and advising to trial in a range of professional negligence cases, including those involving solicitors, financial advisors, surveyors, architects, quantity surveyors and engineers.  He has particular experience in professional negligence cases involving construction professionals.    

  

Insurance

Charles has litigated a range of insurance and reinsurance matters on a wide range of policies, including professional indemnity, material damage and buildings and contents covers.  Issues handled have included policy construction, non-disclosure, breach of warranty (including claims under the NHBC Buildmark Policy), proof of loss and repudiation.

  

Commercial Litigation

Charles has experience in a wide range of commercial litigation, including sale and purchase agreements, contracts of guarantee and bonds.  He has acted for clients both within and outside the jurisdiction, often involving conflicts of law.  He has appeared in the High Court on applications and trials.  He has also advised and acted in arbitrations and has regularly acted for clients in successful mediations and other forms of ADR, including the Court Settlement Process in the TCC.

 

Publications/Seminars

He is one of the editors of Emden's Construction Law and a contributor to Construction Insurance and UK Construction Contracts (Marshall Levine and Roger ter Haar QC).

TALKS AND SEMINARS

He has given a number of talks and seminars in relation to issues in commercial, construction and insurance law.  Recently, he gave a seminar on claims in involving the escape of water.  He will be giving further seminars in September / October in relation to quantification and remoteness of damage in property damage claims.
