James Medd & Richard Sage successfully argue that halogen downlighter and not hot works caused fire

James Medd, instructed by Weightmans LLP and Richard Sage, instructed by Hextalls Limited have just successfully defended a fire claim brought against two Defendants. The Claimant alleged that the cause of the fire was either hot works carried out in a loft space or the careless use of smoking materials. The Judge (Soole J. sitting in the Technology and Construction Court) found that the cause of the fire was in fact that sawdust had dropped onto the exposed back of a downlighter and that this had not been caused by the negligence of Richard’s clients.
