Charles Pimlott successfully acts in an adjudication enforcement in the TCC where the operation of the slip rule is considered



PP Construction Ltd v Geoffrey Osbourne Ltd [2015] EWHC 325 (TCC), Stuart-Smith J.

The TCC considered the operation of the ‘slip rule’ in the context of a contractual adjudication where it was alleged that the corrected decision was issued out of time and therefore unenforceable. The Court held that the corrected ‘slip’ decision was issued in time and therefore enforceable. Although confined to consideration of a bespoke contract clause, the case is nevertheless likely to be of wider interest to those considering whether or not a decision corrected under the slip rule (whether pursuant to the Scheme or contract) was issued in time.
