Damages in tort for non-economic loss to increase by 10% from 1 April 2013



The Court of Appeal this morning handed down judgment in Simmons v Castle [2012] EWCA Civ 1039, in which Andrew Davis appeared for the Defendant. The Court of Appeal took the opportunity to announce an increase in general damages for (i) pain, suffering and loss of amenity in respect of personal injury, (ii) nuisance, (iii) defamation and (iv) all other torts which cause suffering, inconvenience or distress to individuals with effect from 1 April 2013, to fit in with the Jackson reforms. The judgment is available below.

Update:

The Court of Appeal handed down a further judgment on 22 August following an application by the ABI for a reconsideration of the damages uplifts. There will be a further hearing on 25 September 2012.
